20:80:01:01. Definitions. Terms used in this article mean:
(1) "ACT," an addiction counselor trainee approved by the board;
(2) "Applicant," a person applying to the board for any purpose relating to that person's
recognition, certification, or licensure by the board;
(3) "Board," the South Dakota Board of Addiction and Prevention Professionals;
(4) "CAC," a certified addiction counselor;
(5) "CPS," a certified prevention specialist;
(6) "Clinical supervisor," a person qualified to provide ongoing assessment and
oversight to ensure a supervisee's academic and work experience meets the requirements set
forth in chapter 20:80:05 and is within the scope of practice for the profession; 4 (7) "Contact hours," the units of measurement for continuing professional training. A
minimum of fifty minutes is required to gain one clock hour of professional training;
(8) "Continuing professional training," training gained from participation in approved
lectures, workshops, seminars, or post secondary education courses related to the field of
addiction counseling, behavioral health, or prevention services;
(9) "Department," the South Dakota Department of Social Services;
(10) "Division," the Division of Behavioral Health, a division of the Department of
Social Services;
(11) "Dually credentialed practitioner," a practitioner certified as a CAC or LAC and
a CPS;
(12) "IC&RC," the International Certification & Reciprocity Consortium;
(13) "LAC," a licensed addiction counselor;
(14) "PST," a prevention specialist trainee approved by the Board;
(15) "Practitioner," a person certified, licensed, or recognized by the Board to practice
addiction counseling or prevention services who holds oneself out to the public by any title or
description of services which uses the words certified addiction counselor, licensed addiction
counselor, addiction counselor trainee, certified prevention specialist, prevention specialist
trainee, or any derivatives thereof;
(16) "Trainee," a status of recognition through the board for a person seeking to
complete the requirements for certified or licensed addiction counselor or certified prevention
specialist while under supervision approved by the Board; and
(17) "Twelve core functions," the twelve core functions of the alcohol and drug
counselor profession are: screening, intake, orientation, assessment, treatment planning, 5 counseling, case management, crisis intervention, client education, referral, reports and record
keeping, and consultation Repealed.

20:80:01:02. International Certification and Reciprocity Consortium reciprocity.
A CAC, LAC, or CPS is eligible to apply to the board for reciprocity through the International
Certification and Reciprocity Consortium (IC&RC) by submitting an application and the
required fee.

The board may grant reciprocity at a certified addiction counselor, certified prevention
specialist, or licensed addiction counselor level for any practitioner who is certified by another
IC&RC member and who holds a reciprocal level credential Repealed.

6 20:80:01:04. Recognition, certification, and licensure process. The process for
obtaining recognition, certification, or licensure is:
(1) The board shall grant ACT or PST recognition status upon completion of the
application and payment of the required application fee. Recognition status is valid for one
year from the date of issuance and subject to renewal. Recognition status may not be renewed
more than four times;
(2) The board shall grant CAC or CPS certification upon completion of the application,
payment of the applicable fee, and successful passage of a required written examination.
Certification is renewed pursuant to SDCL 36-34-13.3; and
(3) The board shall grant LAC licensure upon completion of the application, payment
of the applicable fee, and successful passage of a required written examination. Licensure is
renewed pursuant to SDCL 36-34-13.3 Repealed.

20:80:01:05. Ethical standards. Any person applying for recognition, certification,
or licensure or who is recognized as a trainee or a certified or licensed practitioner by the board 7 shall comply with the ethical standards set forth in the National Association of Alcoholism and
Drug Abuse Counselors/National Certification Commission for Addiction Professionals Code
of Ethics Repealed.

20:80:02:01. Application requirements. An application for the following must be
made in writing on a form prescribed by the board:
(1) Trainee recognition status;
(2) License or certification;
(3) Temporary license or certification;
(4) Renewal of a license, certification, or trainee recognition status;
(5) Inactive license or certificate; or
(6) Reactivated license or certificate.
The application, license, or certification fee must be submitted with the application.
The application fee is non-refundable. 9 The applicant shall verify under penalty of perjury that all information on the
application is true and correct. The electronic submission of an application serves as the
applicant’s signature and verification of the information on the application. The board may
require the applicant clarify information on the application or provide additional information.
An application is not complete until the board receives the required documentation and
fees. An application that remains incomplete one year after the initial submission of the

20:80:02:03. Application for certification or licensure. An application for
certification or licensure must be submitted to the board within one hundred and eighty days
of the applicant completing all academic and work experience requirements for certification or

20:80:02:04. Board review of application for certification or licensure. The board
shall review each completed application for certification or licensure and shall either reject the
application or approve the application and accept the candidate for testing. Within thirty days
of the board's review of the application, the applicant will be notified in writing of the approval

20:80:02:05. Denial of application. The board may deny an application for failure to
meet the applicable certification or licensure requirements set forth in this article or for any
reason set forth in SDCL 36-34-21. The board shall inform the applicant, in writing, of its
reasons for denial. An applicant whose application is denied is entitled to a hearing pursuant

20:80:05:04. CPS academic and work experience requirements. An applicant for
CPS shall meet the following requirements: 18 (1) Have a minimum of a bachelor's degree, evidenced by transcript, from an
accredited post secondary institution;
(2) Have a minimum of three semester hours and a grade of "C" or higher in each of
the following specialized education courses:
(a) Introduction to the study of alcohol use and abuse;
(b) Introduction to the study of drug use and abuse;
(c) Foundations of alcohol and other drug prevention or workshop equivalent
as approved by the board;
(d) Theory and practice of alcohol and drug prevention; and
(e) Ethics for the alcohol and drug professional including six contact hours of
ethics specific to prevention; and
(3) Have a minimum of 2,000 hours of supervised work experience specific to the
prevention specialist domains, including detailed documentation for a minimum of 750 hours
of supervised practical training experience in the prevention specialist domains with a
minimum of 50 hours in each domain Repealed.

20:80:05:06. ACT academic and work experience requirements. An applicant for
ACT shall meet the following requirements: 19 (1) Have a minimum of a high school diploma or general education diploma;
(2) Be employed by or volunteer for an agency to participate in activities related
specific to the alcohol and drug counselor domains to include the 12 core functions as defined
in § 20:80:01:01;
(3) Be supervised by a qualified CAC or LAC throughout the entire recognition period
as a trainee;
(4) Adhere to all applicable ethical standards adopted by the board;
(5) Identify oneself to the public as an addiction counselor trainee; and
(6) Before the trainee recognition period ends, complete all academic and work
experience requirements for certification or licensure as defined in §§ 20:80:05:09 or
20:80:05:10 and successfully pass the examination as defined in chapter 20:80:07 Repealed.

20:80:05:07. PST academic and work experience requirements. An applicant for
PST shall meet the following requirements:
(1) Have a minimum of a bachelor's degree, evidenced by transcript, from an
accredited post secondary institution;
(2) Be employed by or volunteer for an agency to participate in activities related
specific to the prevention specialist domains as defined by IC&RC; 20 (3) Be supervised throughout the entire recognition period by a qualified CPS. If a
qualified CPS is unavailable, the PST may be supervised by a qualified CAC or LAC;
(4) Adhere to all applicable ethical standards adopted by the board;
(5) Identify oneself to the public as a prevention specialist trainee; and
(6) Before the trainee recognition period ends, complete all academic and work
experience requirements for certification as defined in § 20:80:05:04 and successfully pass the
examination as defined in chapter 20:80:07 Repealed.

20:80:05:09. CAC academic and work experience requirements. An applicant for
CAC shall meet the following requirements:
(1) Have a minimum of a high school diploma or general education diploma;
(2) Have a minimum of three semester hours and a grade of "C" or higher in each of
the following undergraduate or graduate level specialized education courses:
(a) Introduction to the study of alcohol use and abuse;
(b) Introduction to the study of drug use and abuse;
(c) Alcohol and drug group counseling;
(d) Ethics for the alcohol and drug professional; 21 (e) Foundations of individual counseling;
(f) Alcohol and drug treatment continuum;
(g) Counseling families with alcohol or other drug issues;
(h) Diverse populations; and
(i) Alcohol and drug specific elective; and
(3) Have the following minimum number of hours of supervised work experience
specific to the alcohol and drug counselor domains together with the corresponding diploma
or degree: 8,000 hours of work experience and a high school diploma or general education
diploma; 6,000 hours of work experience and an associate's degree; 4,000 hours of work
experience and a bachelor's degree; 2,000 hours of work experience and a master's degree or
above. The degree must be in a behavioral science field and from an accredited post secondary
institution. Applicants shall provide detailed documentation for a minimum of 300 hours of
the required supervised work experience in the 12 core functions with a minimum of ten hours
in each core function Repealed.

20:80:05:10. LAC academic and work experience requirements. An applicant for
LAC shall meet the following requirements:
(1) Have a minimum of a master's degree in a behavioral science field, evidenced by
transcript, from an accredited post secondary institution; 22 (2) Have a minimum of three semester hours and a grade of "C" or higher in each of
the following specialized education courses, with a minimum of five courses at the graduate
level:
(a) Addiction counseling theories and techniques;
(b) Psychopharmacology or psychopathology;
(c) Legal, ethical, and professional standards;
(d) Case management and assessment of co-occurring disorders;
(e) Treatment planning;
(f) Clinical supervision; and
(g) Multicultural competency; and
(3) Have a minimum of 2,000 hours of supervised work experience specific to the
alcohol and drug counselor domains, including detailed documentation for a minimum of 300
hours of supervised practical training experience in the 12 core functions with a minimum of
ten hours in each core function Repealed.

20:80:05:11. CAC requirement exemption. An applicant for CAC is exempt from
the requirements in § 20:80:05:09 if the applicant holds certification as a Certified Chemical
Dependency Counselor Level II (CCDC II) before April 1, 2014. 23 An applicant for CAC who holds certification as a Certified Chemical Dependency
Counselor Level I (CCDC I) before April 1, 2014, will maintain their CCDC I status until
completion of the academic and work experience requirements in § 20:80:05:09 Repealed.

20:80:05:12. LAC requirement exemption. An applicant for LAC is exempt from
the requirements in § 20:80:05:10 if the applicant holds certification as a Certified Chemical
Dependency Counselor Level III (CCDC III) before April 1, 2014.
An applicant for LAC is exempt from the requirements in § 20:80:05:10 if the applicant
holds certification as a Certified Chemical Dependency Counselor Level II (CCDC II) before
April 1, 2014, and successfully completes one of the following options before April 1, 2014:
(1) A minimum of a master's degree in a behavioral science field, evidenced by
transcript, from an accredited post secondary institution;
(2) A minimum of a bachelor's degree in a behavioral science field, evidenced by
transcript, from an accredited post secondary institution and five years of clinical addiction
counseling experience;
(3) A minimum of an associate's degree in a behavioral science field, evidenced by
transcript, from an accredited post secondary institution and 10 years of clinical addiction
counseling experience; or 24 (4) A minimum of a high school diploma or general education diploma and 15 years
of clinical addiction counseling experience.
Any applicant who holds certification as a CCDC II and meets the requirements above
shall submit an application and official transcripts showing proof of degree with the board prior
to July 1, 2014, on a form and in the manner prescribed by the board. The years of clinical
addiction counseling experience must be years accrued after initial certification Repealed.

20:80:05:13. Approval of specialized education courses. All specialized education
courses must be approved by the board and must be completed at an accredited post secondary
institution. The applicant shall submit a course evaluation form provided by the board, the
required fee, a transcript from the post secondary institution, and the course syllabus. The board
shall maintain and make available upon request the list of approved specialized education
courses Repealed.

20:80:05:14. Independent practice. In order for a practitioner to qualify as a private
independent addiction counselor, a practitioner shall meet the following requirements:
(1) Hold an active LAC credential with the board; and
(2) Have completed a minimum of two years of qualifying supervised work experience
in the field of addiction counseling following initial certification or licensure.
The requirements of this section do not apply to any person engaged in independent
practice prior to April 1, 2014 Repealed.

supervision for every ten hours of client contact. The methods that may be used are intensive
case review and discussion utilizing direct observation of a practitioner in action via videotape,
direct live observation of sessions, co-counseling, process recordings, simulations, role
playing, direct or indirect observation of clinical practice via case presentations, verbatim case
reviews, quality care reviews, and other methods consistent with providing supervisory
services.
Supervision must be face-to-face whenever possible. Not more than 50 percent of the

20:80:06:03. Supervisor requirements and duties. The supervisor of an ACT shall
be a qualified CAC or LAC. The supervisor of a PST shall be a qualified CPS. If a CPS is
unavailable, the supervisor may be a qualified CAC or LAC who shall be approved by the
agency that employs the PST. To qualify as a supervisor, the practitioner shall:
(1) Hold an active CAC, LAC, or CPS credential with the board;
(2) Have administrative, evaluative, and professional development skills and
knowledge;
(3) Adhere to all applicable ethical standards adopted by the board; 28 (4) Uphold the federal, state, local, and agency rules and regulations regarding
professional practice;
(5) Evaluate a supervisee's skills, experience with, and knowledge of the alcohol and
drug counselor domains or the prevention specialist domains as defined by IC&RC;
(6) Assist the supervisee in the certification, licensure, or upgrade process. The
supervisor shall be knowledgeable of the current standards and criteria to ensure proper
supervision and guidance in the certification or licensure process; and
(7) Ensure that each supervisee is familiar with all applicable ethical standards adopted
by the board.
A practitioner who is employed in a designated clinically and medically underserved
area and experiencing circumstances that prevent them from meeting the supervision
requirements, may upon written request, be granted an exception by the board Repealed.

20:80:08:15. Continuing education requirements. A licensee shall complete forty
hours of qualified continuing education in each continuing education cycle. At least four of the
continuing education hours must be on counseling ethics. Continuing education required for
renewal of a license or certificate is prorated in six month increments for a licensee granted an
initial license or certificate during a continuing education cycle. Upon application for renewal, 34 a licensee shall verify under penalty of perjury that all continuing education information
provided on the renewal application is true and correct. The licensee shall provide sufficient
documentation to permit verification of the qualified continuing education if audited by the

20:80:08:17. Qualified continuing education. Qualified continuing education is an
academic course, in-house program, workshop, clinic, forum, lecture, program, seminar, or
other educational activity delivered for the purpose of increasing or sustaining the proficiency
of the licensee in the practice of addiction or prevention counseling. 35 An academic semester credit equals fifteen continuing education hours and an
academic quarter credit equals ten continuing education hours.

20:80:08:20. Credit for presentations and publications. A licensee who has
prepared an academic addiction or prevention counseling course, an addiction or prevention
counseling training workshop, or an addiction or prevention counseling seminar or who has
written, as first author, an addiction or prevention counseling article accepted for publication
in a recognized professional journal is allowed a maximum of ten continuing education hours
in each continuing education cycle for each original presentation or publication. The licensee

20:80:09:09. Failure to renew by deadline for trainee recognition status. Any
trainee who fails to submit the renewal application and fee by the expiration of the trainee's
recognition status automatically loses recognition status. Any trainee who has allowed the 41 trainee recognition status to lapse may reinstate the status within thirty days of the expiration
date, providing the trainee:
(1) Requests reinstatement;
(2) Submits the renewal application and all applicable documentation; and
(3) Pays the application fee and the renewal fee.
Any trainee wanting to reinstate recognition status after the thirty day reinstatement
period shall successfully complete three of the courses required for either CPS, CAC, or LAC
Repealed.

(6) "Case management," services to coordinate necessary services for the care,
treatment and social supports for a client related to support for recovery;
(7) "Client education," providing information about addiction, recovery, and available

(8) "Counseling," face-to-face or telehealth interaction between an addition counselor
or addiction counselor supervisee and a client for a specific therapeutic purpose;
(9) "Department," the South Dakota Department of Social Services;
(10) "Dually credentialed practitioner," an individual who is simultaneously certified
or licensed as an addiction counselor and certified as a prevention specialist;
(11) "Peer support core competencies," knowledge, skills and attitudes related to a
recovery-oriented, person-centered, voluntary, relationship-focused, and trauma-informed
principles for substance addiction recovery;
(12) "Peer support specialist," an individual who meets the educational, work
experience, and examination requirements of this article 47 (13) "Prevention domains," six areas designed to measure an individual's competency
in addiction prevention that includes planning and evaluation, prevention education and service
delivery, communication, community organization, public policy and environmental change,
and professional growth and responsibility;
(14) "Prevention specialist," an individual who meets the educational, work experience,
and examination requirements of this article;
(15) "Recognition," a status granted by the board to a trainee or supervisee;
(16) "Recordkeeping," systematic documentation of a client assessment, treatment
plan, progress notes, discharge summaries, and other necessary information;
(17) "Recovery," the process of abstaining from addictive substances and behaviors,
managing disease symptoms, and actively improving one's physical, psychological and social
well-being;
(18) "Referral," connecting a client with external resources or specialists to meet needs
related to an addiction;
(19) "Supervisee," the recognition of an individual under the supervision of a board
approved supervisor who meets minimal education requirements while obtaining the required
work experience to be certified or licensed under this article;
(20) "Trainee," the recognition of an individual obtaining the required education and
work experience to be certified or licensed under this article while under the supervision of a
board approved supervisor;
(21) "Treatment planning," the collaborative development of a written treatment plan
with goals and strengths; and 48 (22) "Twelve core functions," the foundational framework of duties performed by a
practitioner that includes assessment, case management, client education, consultation,
counseling, crisis intervention, intake, orientation, recordkeeping, referral, screening, and
treatment planning.

49 20:80:11:02. International Certification and Reciprocity Consortium reciprocity.
An addiction counselor, prevention specialist or peer support specialist certified or licensed by
the board is eligible to apply for reciprocity through the International Certification and
Reciprocity Consortium for recognition by another member board. The board will verify
certification or licensure to the International Certification and Reciprocity Consortium on the
forms prescribed and provided by the International Certification and Reciprocity Consortium.
The board may grant reciprocity to a certified addiction counselor, certified prevention
specialist, certified peer support specialist, or licensed addiction counselor to a practitioner
who is certified by another International Certification and Reciprocity Consortium member
board and who holds a reciprocal credential in the jurisdiction of the other member board.
Reciprocity shall be granted based on substantially similar education and examination
requirements to the credential to be granted.

50 20:80:11:03. National Certification Commission for Addiction Professionals

54 20:80:02:0120:80:12:01. Application requirements. An application for the
following must be made in writing on a form prescribed by the board for:
(1) Trainee recognition status;
(2) Supervisee recognition status;
(3) License or certification;
(3) Temporary license or certification;
(4) Renewal of a license, certification, or trainee recognition status;
(5) Inactive license or certificate; or
(6) Reactivated license or certificate
(7) Reinstated recognition, license or certificate; or
(8) Temporary license or certification.
The application, recognition, license, or certification fee must be submitted with the
application. The application fee is non-refundable.
The applicant shall verify under penalty of perjury that all information on the
application is true and correct. The electronic submission of an application serves as the
applicant's signature and verification of the information on the application. The board may
require the applicant clarify information on the application or provide additional information.
An application is not complete until the board receives the required documentation and
fees. An application that remains incomplete one year after the initial submission of the
application is considered to be withdrawn.

application for certification or licensure must be submitted to the board within one hundred

any work experience and supervision hours accumulated under a plan of supervision to expire

58 20:80:12:04. Application to reinstate an expired plan of supervision. An expired
plan of supervision may be reinstated within thirty days after the date of expiration. An

expiration and the date of reinstatement of the plan of supervision.

75 20:80:12:11. Application for temporary certification or license. An applicant
certified or licensed in addiction counseling, prevention services or peer support services in
another state may apply for a temporary certification or license by submitting to the board:
(1) A completed application;

(3) The applicable certification or license fee;
(4) Verification of a current certification or license as an addiction counselor or
prevention specialist, in good standing, issued by another state licensing board for a continuous
period of at least three years immediately preceding the application;

A temporary license automatically expires ninety days after the date of issuance or

the applicant has a certificate of addiction and prevention studies from an accredited post-
secondary institution. At least two hundred fifty hours of required work experience must be
under supervision that meets the requirements of supervision under this chapter;
(4) Four thousand hours of work experience in a related field at an approved agency if
the applicant has a bachelor's degree in a relevant field. At least two hundred hours of required

127 20:80:18:04. Renewal of approved supervisor status. Approval as a supervisor is
valid from the date of approval through November thirtieth of the next odd-numbered year and
is subject to renewal. An approved supervisor may renew status as an approved supervisor by
submitting to the board a completed application and proof of at least four hours of qualified
continuing education, pursuant to chapter 20:80:19, focused on addiction counseling
supervision, acquired during the current continuing education cycle.
Failure to renew approval as a supervisor by November thirtieth of an odd-numbered
year automatically expires the supervisor approval and any plan of supervision authorized with
the supervisor. A previously approved supervisor may be reinstated as an approved supervisor
upon submission of an application and verification of qualifications, pursuant to this chapter,
as of the date of the application.

meaningful supervision of a supervisee through an intensive, interpersonal, and focused
relationship to facilitate the development of the supervisee during a period of supervision. An

(2) The supervisee functions within the limits of the supervisee's competence;

hours of personal counseling or therapy as work experience hours necessary to meet the work
experience requirements of chapter 20:80:16. The personal counseling or therapy must be with
a certified addiction counselor, licensed addiction counselor, professional counselor,
professional counselor-mental health, certified social worker-private independent practice,
psychologist, or psychiatrist and is subject to verification by the board. Personal counseling or
therapy may not be with the supervisee's approved supervisor. Personal counseling or therapy
may be received in person or through electronic means, as prescribed by chapter 20:80:21.
Work experience hours and supervision hours must be recorded on a form provided by
the board. For purposes of this chapter, only hours acquired with a board approved supervisor
are compliant to meet the work experience and supervision requirements for certification or
licensure.

141 20:80:19:02. Record keeping. A licensee, supervisee and trainee shall maintain
records to verify the required continuing education used to renew a license, certificate or
recognition. A licensee, supervisee and trainee shall maintain records in the form of a
completion certificate or other documents supporting evidence of completion. The records
must be maintained for at least four years after the date of renewal.

142 20:80:08:1720:80:19:03. Qualified continuing education. Qualified continuing
education is an academic course, in-house program, workshop, clinic, forum, lecture, program,
seminar, or other educational activity delivered for the purpose of increasing or sustaining the
proficiency of the licensee, supervisee or trainee in the practice of addiction or counseling,
prevention counseling services or peer recovery. Qualified continuing education must be
evidenced by a certificate of completion from an approved continuing education program.
An academic semester credit equals fifteen continuing education hours and an. An
academic quarter credit equals ten continuing education hours.
The same qualified continuing education may not be repeated by a licensee in
consecutive Book or magazine reviews or other independent self-study not evidenced by a
certificate of completion from an approved continuing education program is not qualified
continuing education cycles.
