The landowner shall notify the commissioner of any hazardous substances known to have been released, stored, or disposed of on the nonstate land to be exchanged prior to the ordering of the appraisal. If hazardous substances are known to be present on the nonstate land, the commissioner shall reach an agreement with the landowner regarding the responsibility for appropriate response action concerning the hazardous substances before completing the exchange.
