The report form required by SDCL 38-21-46 must include: (1) The name and address of person making the report; (2) The telephone number of person making the report; (3) The county and legal description of the property on which the incident occurred or damage is alleged; (4) The date, approximate time, weather conditions including wind direction, and temperature when the application was made, if known; (5) The county and legal description of the property on which the application was made; (6) The operator of the property on which the application was made; (7) A description of the incident or damages; (8) The name of the applicator or operator who applied the pesticides; (9) The name of any witness, if known; (10) Whether ground or aerial application was used and the crop that was treated; (11) The chemical used, if known; (12) Whether the applicator was notified and, if so, when; and (13) The date that the incident form was submitted and the signature of the person completing the form.
