12:56:17:07Pesticide operational area registration.

Effective February 1, 1995, each pesticide operational area using operational area containment as required by § 12:56:17:01 must be registered with the department. The secretary may deny registration or require additional conditions for the registration of any operational area if the registrant's application does not meet the requirements of each provision of this chapter. If departmental investigation determines the facility is not constructed or operating in accordance with the submitted plans and specifications or the requirements of this chapter, the owner must correct any deficiencies as set forth by the department. The secretary may modify, suspend, or revoke the registration of any operational area that has not complied with this chapter.
