The executive secretary must serve upon the summarily suspended licensee a formal commission complaint alleging the violation relied upon and a notice of hearing within five days after the receipt of the suspension notice by the licensee. The complaint must be heard by the commission on an expedited basis as a contested case pursuant to SDCL chapter 1-26.
