event -- Time for filing RBC plan or revised RBC plan. The RBC plan or revised RBC plan must be submitted as follows: (1) Within 45 days after the occurrence of the regulatory action level event; (2) If the insurer or health organization challenges an adjusted RBC report pursuant to § 20:06:36:21 and the challenge is not frivolous in the judgment of the director, within 45 days after the notice to the insurer or health organization that the director has, after a hearing, rejected the insurer's or health organization's challenge; or (3) If the insurer or health organization challenges a revised RBC plan pursuant to § 20:06:36:21 and the challenge is not frivolous in the judgment of the director, within 45 days after the notice to the insurer or health organization that the director has, after a hearing, rejected the insurer's or health organization's challenge.
