44:58:05:01Conduct of hearings generally -- Not in lieu of

criminal prosecutions. Administrative hearings in contested cases shall be governed by the act, this article, and SDCL chapter 1-26. A hearing held for violation of this article is independent of, and not in lieu of, criminal prosecutions or other proceedings under the act or any other law of this state.
