Each provider shall have a policy regarding the confidentiality of participant information to ensure that records, paper or electronic, are protected against loss, tampering, or unauthorized disclosure of information in accordance with 45 C.F.R., Part 160 and 164 (October 1, 2009) and provisions of this chapter. The policy shall include provisions to address how identifiable participant information shall be kept confidential. Information of a statistical nature, which cannot be identified with a specific participant, may be used for planning and public information purposes.
