Before an ICF/IID terminates services to a person supported, the ICF/IID must provide notice of its intention in accordance with SDCL 27B-3-46. Notice must be given both orally and in writing to the person. Accommodations must be made for any person with communication difficulties. The ICF/IID shall provide written notice to the parent, if the person is under eighteen years of age, or the guardian, if any, and the department. The written notice must contain: (1) The reasons for the action; (2) The appeal process; (3) The availability of other services; and (4) The right to appeal the decision to the secretary of the department.
