basis for other than law enforcement positions. Except for a law enforcement position, any promotion shall be made on a competitive basis. The position may be open to all permanent employees of the state who meet the necessary minimum requirements as outlined in the job announcement. A promotional announcement may include employees in specific classes in all departments or may be limited to a single department or organizational unit. The commission shall prepare a list of certified applicants as provided in § 55:10:03:03. The appointing authority shall select an employee in accordance with chapter 55:10:03 and shall report the selection to the commissioner.
