for failing or refusing to participate. If the individual is required to participate in employment and training and fails or refuses to comply with the employment and training requirements of this chapter, the individual is ineligible for supplemental nutrition assistance according to the following schedule: for the first occurrence, one month; for the second occurrence, six months; and for the third and subsequent occurrences, 12 months. The department shall apply these same penalties if any of the following situations occur: (1) The Department of Labor and Regulation employment and training staff reports the recipient quit a job or voluntarily reduced job hours without good cause; (2) The applicant quit a job or voluntarily reduced job hours without good cause within 60 days prior to or during the application month; (3) The recipient quit a job or voluntarily reduced job hours without good cause within 30 days prior to or during the month the report form or recertification form is received by the department; or (4) The individual fails to comply with the requirements contained in § 67:13:02:02.
