of out-of-state foster care. If a foster parent moves out-of-state with a child in foster care, the department shall reimburse the foster parent at the foster care rate established by that state or South Dakota's foster care rate, once the foster parent is licensed in the new state. The rate must be negotiated between South Dakota and the new state. If the department places a South Dakota child into an out-of-state foster home, the department may reimburse the out-of-state foster parent at the foster care rate established by that state.
