If the State Mental Health Authority or State Intellectual Disability Authority determines that an individual requires medicaid-certified nursing facility services, the authorities must also determine whether the individual would benefit from specialized services. If the authorities determine that the individual requires both medicaid-certified nursing facility services and specialized services, the facility may admit or retain the individual, and the authorities must provide or arrange to provide the specialized services needed by the individual in the medicaid-certified nursing facility. If the authorities determine that the individual does not require medicaid-certified nursing facility services but would benefit from specialized services, the authorities must provide the individual with information regarding service options.
