withholding action. An individual contesting a withholding order under the provisions of SDCL 25-7A-26 has ten days after petitioning the department to provide documentation to the department which substantiates the petition. If the petition meets the requirements of SDCL 25-7A-26 and the supporting documentation is received on time, the department shall conduct an administrative review of the proposed withholding action. The department may modify, suspend, or terminate the order for withholding as provided under SDCL 25-7A-38. The department shall deny a petition if the petition does not meet the requirements of SDCL 25-7A-26 or if the supporting documentation is not received on time.
