intermediate care for individuals with intellectual disabilities or intermediate care for the mentally disabled -- Payment limits. When a nursing facility is unable to meet the needs of the individual because the need is for intermediate care for an individual with an intellectual disability or intermediate care for the mentally disabled, the department shall refer the individual to the Department of Human Services for assistance in finding an appropriate facility. Payment to the facility will continue for a maximum of 60 days or until the date of transfer to an intermediate care facility for individuals with intellectual disabilities or to an intermediate care facility for the mentally disabled, whichever occurs first.
