Other reasonable classifications of children. A child under age 21 is eligible for Medicaid assistance if the child; (1) Is in an adoption that is subsidized in full or part by a public agency; (2) Resides in a nursing or intermediate care facility; (3) Is under the custody of the department; (4) Is in foster care and the department is assuming full or partial financial responsibility; (5) Is under the jurisdiction of the Department of Corrections and is not an inmate of a public institution under the provisions of 42 CFR 435.1008; (6) Is adjudicated under the guardianship of the South Dakota Human Services Center and is receiving inpatient psychiatric treatment for drug or alcohol dependency; or (7) Is adjudicated under the guardianship of the South Dakota Human Services Center and is receiving inpatient psychiatric treatment. The child must also meet the requirements in Chapter 67:46:01 and have income within limits specified in § 67:46:12:15.
