notification of drinking water violation -- Tier 1 public notice -- Frequency. Public water systems with a Tier 1 violation or other situation as specified in 40 C.F.R. § 141.202 (July 1, 2018) shall provide public notice according to the following criteria: (1) Provide a public notice as soon as practical, but not later than 24 hours after learning of the violation; (2) Initiate consultation with the department as soon as practical, but not later than 24 hours after learning about the violation or other situation, to determine additional public notice requirements; and (3) Comply with the following additional public notification requirements: (a) Duration. Once the public notification is posted, the notice must remain in place until the violation or situation has been resolved as determined by the department. However, in no case may a notice be posted for less than seven days, even if the violation or situation has been resolved; and (b) Broadcast media. A public notification made by broadcast media must be aired a minimum of three times during the 24-hour period specified in subdivision (1) of this section.
