74:07:01:03Preparation of estimated amount of financial

assurance -- Department recommendation. If the department recommends posting of financial assurance as a condition of permit approval, the owner or operator shall provide an estimated amount of financial assurance for board consideration at the hearing on the permit application. Whether or not the department recommends posting of financial assurance, the board may require an owner or operator to post financial assurance consistent with provisions of §§ 74:07:01:02 and 74:07:01:04.
