for new Type I and IIA facilities. An applicant for a new Type I or IIA facility shall submit a Phase I application. The secretary shall determine if a permit application may proceed by: (1) Evaluating the Phase I application; (2) Conducting a feasibility inspection of the proposed location; and (3) Conducting a background investigation to determine the applicant's reputation, qualifications, and experience.
