The owner or operator shall analyze leachate constituents prior to disposal. The secretary shall designate the sampling parameters. Sampling methods and analytical techniques must conform to the requirements of § 74:54:01:06. The owner or operator may not allow leachate to accumulate to a depth greater than 12 inches above the final liner grade at any point in the leachate collection system. Leachate disposal may be accomplished through the following means: (1) Surface application of leachate over daily or interim cover areas that are underlaid by both a liner system and a leachate collection system; (2) Discharge to a wastewater treatment facility if the leachate quality meets the pretreatment requirements of 40 C.F.R. Part 403, (July 1, 1991) and with the owner or operator of the treatment facility's permission; (3) Discharge from a leachate storage or treatment lagoon if the leachate quality meets the requirements of 40 C.F.R. Part 133 (July 1, 1992); or (4) Other methods approved by the secretary based on the constituents of the leachate, the volume of leachate, and the proposed handling methods.
