74:36:07:38Compliance schedule for existing municipal solid waste landfills.

The owner or operator of an existing municipal solid waste landfill that meets the requirements of § 74:36:07:34 must meet the following compliance dates: (1) Award contracts within 15 months of the first annual report showing the nonmethane organic compound emissions equal or exceed 50 megagrams a year; (2) Begin construction within 18 months of the first annual report showing the nonmethane organic compound emissions equal or exceed 50 megagrams a year; (3) Complete construction within 30 months of the first annual report showing the nonmethane organic compound emissions equal or exceed 50 megagrams a year; and (4) Demonstrate compliance with all applicable requirements within 180 days of completing construction. This section is no longer in effect on the effective date of EPA's approval of the state's § 111(d) plan required in the Clean Air Act. The secretary shall certify to the Interim Rules Review Committee that the approval has occurred.
