The secretary may issue a general permit in accordance with the following: (1) The general permit shall be written to cover a category of discharges described in the permit under subdivision (2) of this section, except those covered by individual permits, within a geographic area; (2) The general permit may be written to regulate, within the area described in subdivision (1) of this section, either: (a) Storm water point sources; or (b) A category of point sources or industrial users if the sources all meet the following requirements: (i) Involve the same or substantially similar types of operations; (ii) Discharge the same types of wastes; (iii) Require the same effluent limitations, operating conditions, or standards for sewage sludge use or disposal; (iv) Require the same or similar monitoring; and (v) In the opinion of the secretary, are more appropriately controlled under a general permit.
