Any A person, other than is guilty of a Class 1 misdemeanor if the person is not a law enforcement officer as defined in § 22-1-2 acting under color of authority, who or a person who is a resident of this state who meets the requirements of subdivisions 23-7-7.1(1) to (5), inclusive, and subdivisions 23-7-7.1(7) to (10), inclusive, and: (1)Carries a pistol or revolver, loaded or unloaded, concealed on or about his or her person the person's body without a permit as provided in chapter 23-7; or10 (2)Carries a pistol or revolver, loaded or unloaded, concealed in any vehicle while11 operating the vehicle, without a permit as provided in chapter 23-7; is guilty of a Class 1 misdemeanor.
