Section 13-28-2 — AMENDED
Kindergarten enrollment eligibility--Exceptions. Any A child who is five years old on the first day of may not be enrolled in kindergarten unless: (1) The child turned five on or before September is eligible for first in the year of enrollment in kindergarten during that school year. Any child who transfers from another state may proceed in a continuous educational program without interruption; (2) The child turns five before December thirty-first in the year of enrollment and by means of developmental and readiness screening instruments approved by the Department of Education and administered by the school district or nonpublic school, demonstrates superior academic talents or abilities and social and emotional readiness; (3) The child was enrolled in a public or nonpublic kindergarten in this state in accordance with subdivision (2) and due to a relocation seeks to enroll in another public or nonpublic kindergarten in this state; or (4) The child was enrolled in a public or nonpublic kindergarten in another state and due to a relocation seeks to enroll in a public or nonpublic kindergarten in this state. 21
