NEW SECTION added to Chapter 1-27
A settlement agreement entered into by the Associated School Boards of South Dakota Protective Trust Workers Compensation Pool is subject to the same requirements of disclosure that are applicable to settlement agreements in § 1-27-1.23. The settlement agreement must refer to this section and contain a provision stating that the terms and amount of the agreement are discoverable, unless otherwise expressly exempt under chapter 1-27. Any provision of a settlement agreement entered into by the Associated School Boards of South Dakota Protective Trust Workers Compensation Pool after July 1, 2025, which is in violation of this section, is void and unenforceable. 14
