This bill creates a new law prohibiting foreign entities and non-citizens from countries on a restricted list from owning, operating, or controlling electric power infrastructure in South Dakota, including power plants, transmission lines, and distribution systems. Any contracts or agreements that would give these prohibited persons control over electric facilities become unenforceable if signed after July 1, 2026, and facilities in violation can be seized by the state.
This bill does not directly amend codified state law.
