South Dakota's Department of Social Services must ask the federal government for permission to ban soft drinks from the state's food assistance program by September 2026. If approved, the department would implement the ban within six months; if rejected, it must resubmit the request annually until approved. Soft drinks are defined as sweetened beverages, but milk products and certain approved juices would still be allowed.
