South Dakota law prohibits registered sex offenders from living within "community safety zones" (areas around schools, parks, playgrounds, pools, and domestic abuse or sexual assault shelters), but this bill adds a new exception allowing those who established a residence by July 1, 2024 in an area that later became a safety zone to continue living there. The bill also clarifies that sex offenders can reside in these zones if they're incarcerated, in supervised living, homeless shelters, health care facilities, or if they were minors at the time of their offense and weren't tried as adults.
This bill does not directly amend codified state law.
