An Act to revise the types of community-based providers for purposes of state 1 funded services. 2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3 Section 1. That § 28-22-6 be AMENDED: 4 28-22-6. This chapter applies to all state funded services, including federal 5 funding, Medicaid and block grant fund sources, state general funds, and other funds 6 allocated by the Department of Social Services or the Department of Human Services, 7 that are provided by the following types of community-based providers: 8 (1) Nursing facilities; 9 (2) Assisted living facilities; 10 (3) In-home service providers; 11 (4) Group care providers; 12 (5) Psychiatric residential treatment facilities; 13 (6) Substance abuse disorder treatment and prevention providers; 14 (7) Community mental health centers; 15 (8) Intermediate care facilities for co-occurring intellectual and developmental 16 disabilities; 17 (9) Community support providers; and 18 (10) Critical access hospitals as defined in § 34-12-1.1; 19 (11) Federally Qualified Health Centers; and 19 (10)(11) 20 (10)(12) Other types of providers deemed appropriate for inclusion by either the 20 21 secretary of the Department of Social Services or the secretary of the Department 21 22 of Human Services. 22 23
