An Act to make an appropriation for the construction of a juvenile corrections center non-residential, school-based, therapeutic 1 services facility in Brown County and to declare an emergency. 2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3 Section 1. There is appropriated $2,000,000 from the general fund, to the Department of 4 Corrections, to contract Education for the construction, completion, purpose of providing a grant to an eligible nonprofit organization to acquire, 5 renovate, and equipping equip a facility in which the organization may offer non-residential, school-6 based, therapeutic services for students receiving instruction in an alternative setting. 7 Section 2. A nonprofit organization is eligible for the grant under section 1 of this Act only if 8 the organization demonstrates experience in operating a regional juvenile 5 corrections center program that offers integrated 9 educational and therapeutic services, in Brown County, including heating, plumbing, water, sewer, electric 6 facilities, architectural and engineering services, partnership with school districts and other services or actions community 10 systems. The nonprofit organization may not use any moneys awarded as may be 7 required. 8 Section 2. The administration part of the design and construction of the project authorized in this 9 Act is under the general charge and supervision of the Bureau of Human Resources and 10 Administration, as provided in chapter 5-14. grant 11 to provide residential treatment, inpatient services, or twenty-four-hour care for a student. 12 Section 3. The secretary of the Department of Corrections Education shall approve vouchers and the 12 13 state auditor shall draw warrants to pay expenditures authorized in this Act. 13 14 Section 4. Any amounts appropriated in this Act not lawfully expended or obligated shall 14 15 revert in accordance with the procedures prescribed in chapter 4-8. 15 16 Section 5. Whereas, this Act is necessary for the support of the state government and its 16 17 existing public institutions, an emergency is hereby declared to exist, and this Act shall be in 17 18 full force and effect from and after its passage and approval. 18 19
