ENROLLED AN ACT ENTITLED An Act to make an appropriation for the design and construction of an indoor 1 athletics facility at Dakota State University and to declare an emergency. 2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3 Section 1. The Board of Regents may contract for the design and construction of an indoor 4 facility for athletic practice and competitive activities at the Beacom PREMIER Complex on the 5 campus of Dakota State University in Madison, together with furnishings and equipment, 6 including heating, air conditioning, plumbing, water, sewer, electric facilities, refrigeration, 7 laboratories, sidewalks, parking, landscaping, architectural and engineering services, and 8 other services or actions, including the movement, construction, or expansion of the South 9 Dakota National Guard motor vehicle storage complex, as may be required to accomplish the 10 project, for an estimated cost of $13,330,000, subject to permitted adjustments pursuant to 11 section 3 of this Act. 12 Section 2. There is appropriated to the Board of Regents for the purposes authorized in this 13 Act, the sum $13,330,000, in other fund expenditure authority for donated moneys, together 14 with any additional sums received pursuant to section 4 of this Act, and permitted adjustments 15 pursuant to section 3 of this Act. 16 Section 3. The cost estimate contained in this Act is stated in terms of 2026 values. The 17 Board of Regents may adjust the cost estimate to reflect inflation, as measured by the Building 18 Cost Index and reported by the Engineering News Record, and additional expenditures 19 required to comply with regulations adopted after the effective date of this Act, or additional 20 sums received pursuant to section 4 of this Act.
