An Act to make an appropriation for the design and construction of an indoor 1 athletics facility at Dakota State University and to declare an emergency. 2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3 Section 1. The Board of Regents may contract for the design and construction of an indoor 4 facility for athletic practice and competitive activities at the Beacom PREMIER Complex on the 5 campus of Dakota State University in Madison, together with furnishings and equipment, 6 including heating, air conditioning, plumbing, water, sewer, electric facilities, refrigeration, 7 laboratories, sidewalks, parking, landscaping, architectural and engineering services, and 8 other services or actions, including the movement, construction, or expansion of the South 9 Dakota National Guard motor vehicle storage complex, as may be required to accomplish the 10 project, for an estimated cost 9 of $13,330,000, subject to permitted adjustments pursuant to 11 section 3 of this Act. 10 12 Section 2. There is appropriated to the Board of Regents for the purposes authorized in this 11 13 Act, the sum $13,330,000, in other fund expenditure authority for donated moneys, together 12 14 with any additional sums received pursuant to section 4 of this Act, and permitted adjustments 13 15 pursuant to section 3 of this Act. 14 16 Section 3. The cost estimate contained in this Act is stated in terms of 2026 values. The 15 17 Board of Regents may adjust the cost estimate to reflect inflation, as measured by the Building 16 18 Cost Index and reported by the Engineering News Record, and additional expenditures 17 19 required to comply with regulations adopted after the effective date of this Act, or additional 18 20 sums received pursuant to section 4 of this Act. Any adjustment to construction cost estimate 19 21 for the project may not exceed one hundred twenty-five percent of the estimated project 20 22 construction cost stated in section 1 of this Act. 21 23 Section 4. The administration of the design and construction of the project authorized in this 6 7 Act shall be under the general charge and supervision of the Bureau of Human Resources and 7 8 Administration, as provided in chapter 5-14. 8 9 Section 7. The executive director of the Board of Regents, shall approve vouchers, and the 9 10 state auditor shall draw warrants to pay expenditures authorized by this Act. 10 11 Section 8. Any amounts appropriated in this Act not lawfully expended or obligated shall 11 12 revert in accordance with the procedures prescribed in chapter 4-8. 12 13 Section 9. Whereas, this Act is necessary for the support of the state government and its 13 14 existing public institutions, an emergency is hereby declared to exist, and this Act shall be in 14 15 full force and effect from and after its passage and approval. 15 16
