An Act to amend the requirements for filing certain campaign finance disclosure 1 statements. 2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3 Section 1. That § 12-27-22 be AMENDED: 4 12-27-22. The treasurer of a political committee listed below shall file a campaign 5 finance disclosure statement or a report the following campaign finance disclosure 6 statements with the secretary of state as follows: 7 (1) For a candidate or candidate campaign committee for any statewide office, file a 8 pre-primary, pre-general, year-end, and, if applicable, supplemental report and 9 amendments in even numbered years and in odd numbered years, file a year-end 10 report and, if applicable, amendments: 11 (a) A pre-primary statement; 12 (b) A pre-general statement; 13 (c) A An annual year-end statement; 14 (d) A supplemental report as provided in § 12-27-28, if applicable; and 15 (e) In even-numbered years, if If applicable, amendments to any information 16 provided on a prior 16 statement; 17 (2) For a candidate or candidate campaign committee for a legislative or county office 18 with a recognized political party, file a pre-primary, a pre-general, year-end and, 19 if applicable, supplemental report and amendments in even numbered years: 20 (a) A pre-primary statement; 21 (b) A pre-general statement; 22 (c) A An annual year-end statement, annually; statement; 23 (d) A supplemental report as provided in § 12-27-28, if applicable; and 24 (e) In even-numbered years, if If applicable, amendments to any information 25 provided on a prior 25 statement; 26 26.805.10 26.805.11 2 142 Underscores indicate new language. (e) In even-numbered years, if If applicable, amendments to any information 1 provided on a prior 1 statement. 2 The treasurer of a political committee listed in this section may submit a 3 termination report statement at any time. 4 If a political party loses the status of a qualified party, the party must file a 5 termination report statement by five p.m. central time on the last Friday in January 6 following the calendar year in which the qualified party status was lost. If a statewide 7 ballot question committee does not list any activity on the next required campaign finance 8 report statement submitted to the secretary of state, that committee has until the next 9 reporting period to report activity. If that committee does not have any activity to report 10 by the next reporting period, the committee must submit a termination report statement 11 by that reporting period deadline. 12 A violation of this section is a Class 2 misdemeanor. A subsequent offense within 13 a calendar year is a Class 1 misdemeanor. 14 Section 2. This Act is effective beginning January 1, 2027. 15
