An Act to create the Developmental Disability Services Oversight Service Delivery Committee. 1 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 2 Section 1. That a NEW SECTION be added to chapter 2-6: 3 There is created the Developmental Disability Services Oversight Service Delivery Committee. The 4 committee shall: 5 (1) Examine the medicaid waiver programs, administered by the Department of 6 Human Services, that which provide home and community-based services to individuals 7 with intellectual and developmental disabilities; disabilities, for the purposes of: 8 (a) Streamlining provider biennial review and accreditation requirements to 9 reduce administrative burden, improve clarity and consistency, and support 10 sustainable, individual-centered service delivery; and 11 (b) Assessing roles and responsibilities to ensure that current practice, policy, 12 and service delivery match system realities; 13 (2) Monitor the implementation of changes to the waiver programs by the Department 9 of Human Services; 10 (3) Hear testimony from the Department of Human Services on the operation of, and 11 14 changes to, the waiver programs; 12 (4) 15 (3) Seek feedback from individuals with intellectual and developmental disabilities, 13 16 their family members, community support providers, and case management 14 17 organizations regarding the administration of services provided under the waiver programs programs; and the 15 provision of services; and 16 (5) 18 (4) Consider proposed legislation or changes to the waiver programs to improve 17 services, operations, 19 services and efficiency. 18 20 Section 2. (2) The chairs of the appropriations committees of the House of Representatives and 1 3 the Senate; 2 4 (3) Two members of the House of Representatives, appointed by the speaker of the 3 5 House of Representatives; 4 6 (4) Two members of the Senate, appointed by the president pro tempore of the 5 7 Senate; and 6 8 (5) One member of the minority party, appointed by the Executive Board of the 7 9 Legislative Research Council. 8 10 Each appointed member shall serve for a term that expires on January first of each 9 11 odd-numbered year and may be reappointed without limit. If a position becomes vacant, 10 12 the position must be filled, for the duration of the term, in the same manner as the original 11 13 appointment. 12 14 The Executive Board shall appoint one member to serve as chair, and one member 15 to serve as vice-chair. 16 Section 3. That a NEW SECTION be added to chapter 2-6: 13 17 The Executive Board of the Legislative Research Council shall provide 14 18 administrative services to the Developmental Disability Services Oversight Service Delivery Committee. 15 At the initial meeting of the committee and annually thereafter, the members shall 16 select one among its members to serve as the chair. 17 19 The committee shall meet at least one time per year, at the call of the chair. 18 20 Section 4. That a NEW SECTION be added to chapter 2-6: 19 21 On or before November first December thirty-first of each year, the Developmental Disability Services 20 Oversight 22 Service Delivery Committee shall provide a report to the Executive Board of the Legislative 21 23 Research Council. The report must include: 22 24 (1) A description of the committee's work; and 23 25 (2) Any recommendations or proposed legislation to improve the services, operations, 24 services and 26 efficiency of the medicaid waiver programs operated by the Department of 25 Human 27 Services. 26 28
