South Dakota candidates and political committees are now prohibited from accepting contributions or loans from foreign nationals, foreign governments, and certain other sources including state and federal agencies. Violating this ban is a Class 1 misdemeanor, with subsequent violations in the same calendar year treated as a Class 6 felony. The law takes effect immediately upon passage.
The enrolled version makes primarily technical and formatting corrections to the introduced bill, including changing the penalty for a first violation from a Class 2 misdemeanor to a Class 1 misdemeanor and adjusting punctuation in the list of prohibited contribution sources. These changes marginally STRENGTHEN the bill's enforcement mechanism by increasing the severity of penalties for foreign contribution violations.
