South Dakota election officials must now provide black ink pens to in-person voters marking optical scan ballots and give absentee voters instructions to use black ink pens, replacing the previous allowance for pencils or other marking instruments. However, election officials cannot reject ballots marked with instruments other than black ink pens, ensuring that voter intent is honored regardless of what writing tool was used.
