An Act to revise certain criteria for loans from the South Dakota housing 1 infrastructure fund. 2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3 Section 1. That § 11-15-1 be AMENDED: 4 11-15-1. Terms used in this chapter mean: 5 (1) "Authority," the South Dakota Housing Development Authority; 6 (2) "Housing infrastructure," the installation, replacement, upgrade, or improvement 7 of public infrastructure for the support of a single-family or multi-family housing 8 project; and 9 (3) "Public infrastructure," a right of way, water distribution system, sanitary sewer 10 system, storm sewer system, lift station, street, road, bridge, curb, gutter, 11 sidewalk, traffic signal, or streetlight, which is or will be located in the state and is 12 or will be owned, maintained, or provided by a political subdivision of this state or 13 federally recognized Indian tribe; or excavation, necessary site work, compaction, 14 or acquisition of land for such purposes support of a single family or multi-family 15 housing project. 16 Section 2. That § 11-15-3 11-15-4 be AMENDED: 17 11-15-3. The authority shall distribute monies moneys from the South Dakota 18 housing infrastructure fund, created in § 11-15-2, as follows: 19 (1) Thirty Fifty percent for housing infrastructure in municipalities having a population 20 of fifty thousand or more; and 21 (2) Seventy Fifty percent for housing infrastructure in all other areas of the state. 22 The authority may not provide both a grant and a loan from the South Dakota 23 housing infrastructure fund for the same housing infrastructure project located in a 24 municipality having a population of fifty thousand or more. 25 26.832.17 2 204 Underscores indicate new language. The authority may make loans from the South Dakota housing 2 18 infrastructure fund, created in § 11-15-2, for housing infrastructure projects. The principal 3 19 amount of a loan may not exceed one-third one-half of the total cost of the housing 4 20 infrastructure project. The authority may use up to one percent of the principal amount of 5 21 a loan to offset the authority's expenses in administering the loan. 6 22
