South Dakota would establish a new charter school system allowing independent public schools to operate under contracts with local school districts or the state Department of Education. Charter schools would be exempt from most state education laws and rules, though they must still comply with civil rights, health, and safety requirements, operate as nonsectarian institutions, and provide in-person instruction to students in kindergarten through grade twelve. This creates a new alternative to traditional public schools in the state.
