ENROLLED AN ACT ENTITLED An Act to clarify that an official open meeting agenda must be posted online at least 1 seventy-two hours before the scheduled start of the meeting. 2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3 Section 1. That § 1-25-1.3 be AMENDED: 4 1-25-1.3. The state shall provide public notice of a meeting, at least seventy-two 5 hours before the meeting is scheduled to start, not including Saturday, Sunday, or any 6 legal holiday, by posting a copy of the proposed agenda at: 7 agenda: (1) At the principal office of the board, commission, or department holding the 8 meeting. The proposed agenda shall include; 9 meeting; (2) That includes the date, time, and location of the meeting, and be; 10 meeting; (3) That is visible, readable, and accessible to the public. The agenda shall be posted 11 at least seventy-two hours before the meeting is scheduled to start according to 12 the agenda. The seventy-two hours does not include Saturday, Sunday, or legal 13 holidays. The notice shall also be posted on; public; and 14 (4) On a state website, designated by the commissioner of the Bureau of Finance and 15 Management. 16 For any special or rescheduled meeting, the information in the notice shall must be 17 delivered in person, or by mail, by email, or by telephone, to members of the local news 18 media who have requested notice.
