Businesses that violate this ban face criminal charges as a Class 2 misdemeanor, stop-sale orders, and potential loss of their food service licenses. The ban does not apply to proteins made through fermentation, enzymes, or other biotechnology methods not intended to replicate meat.
This amendment completely rewrote the bill—removing unrelated livestock transport permitting language and significantly strengthening the cell-cultured protein ban by making department inspections and enforcement mandatory (rather than discretionary), adding explicit license suspension/revocation procedures, and shortening the prohibition period from 2036 to 2031. The bill was gutted and refocused entirely on the cultured meat prohibition with more aggressive enforcement mechanisms.
The amendment converted the bill from its engrossed (working) version to its enrolled (final) version, making minor technical corrections such as fixing the hyphenation of "cell-cultured" and correcting a statute reference from "34-18-27.1" to "34-18-27.1," while adding standard legislative completion language and certification pages. These are routine formatting and clerical changes with no substantive impact on the bill's prohibition of cell-cultured protein sales in South Dakota.
