ENROLLED AN ACT ENTITLED An Act to make an appropriation for the design and construction of a new soccer 1 venue at South Dakota State University and to declare an emergency. 2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3 Section 1. The Board of Regents may contract for the planning, site preparation, 4 construction, completion, furnishing, equipping, and maintaining of a soccer venue at the 5 South Dakota State University, together with any heating, air conditioning, plumbing, water, 6 sewer, electrical, sidewalks, parking, landscaping, and envelope systems, architectural and 7 engineering services, and any other services or actions as may be required for an estimated 8 cost of $5,040,000. 9 Section 2. There is appropriated to the Board of Regents, for the purposes authorized in this 10 Act, the sum of $5,040,000 in other fund expenditure authority for donated moneys, together 11 with any additional sums received pursuant to section 4 of this Act, and permitted adjustments 12 pursuant to section 3 of this Act 13 Act. Section 3. The cost estimate contained in this Act is stated in terms of 2026 values. The 14 Board of Regents may adjust the cost estimate to reflect inflation, as measured by the Building 15 Cost Index and reported by the Engineering News Record, and additional expenditures 16 required to comply with regulations adopted after the effective date of this Act, or additional 17 sums received pursuant to section 4 of this Act. Any adjustment to the construction cost 18 estimate for the project may not exceed one hundred twenty-five percent of the estimated 19 project construction cost stated in section 1 of this Act. 20 Section 4. The Board of Regents may accept, transfer, and expend any moneys obtained for 21 the project authorized in this Act from federal sources, donations, or any other external 22 sources, all of which comprise a special fund for the benefited project. The administration of the design and construction of the project authorized in this 4 Act shall be under the general charge and supervision of the Bureau of Human Resources and 5 Administration as provided in chapter 5-14. 6 Section 7. The executive director of the Board of Regents, shall approve vouchers, and the 7 state auditor shall draw warrants to pay expenditures authorized by this Act. 8 Section 8.
